Several theories link consciousness to complex cortical dynamics, as suggested by comparison of brain signal diversity between conscious states and states where consciousness is lost or reduced. In particular, Lempel-Ziv complexity, amplitude coalition entropy and synchrony coalition entropy distinguish wakefulness and REM sleep from deep sleep and anesthesia, and are elevated in psychedelic states, reported to increase the range and vividness of conscious contents. Some studies have even found correlations between complexity measures and facets of self-reported experience. As suggested by (...) integrated information theory and the entropic brain hypothesis, measures of differentiation and signal diversity may therefore be measurable correlates of consciousness and phenomenological richness. Inspired by these ideas, we tested three hypotheses about EEG signal diversity related to sleep and dreaming. First, diversity should decrease with successively deeper stages of non-REM sleep. Second, signal diversity within the same sleep stage should be higher for periods of dreaming vs. non-dreaming. Third, specific aspects of dream contents should correlate with signal diversity in corresponding cortical regions. We employed a repeated awakening paradigm in sleep deprived healthy volunteers, with immediate dream report and rating of dream content along a thought-perceptual axis, from exclusively thought-like to exclusively perceptual. Generalized linear mixed models were used to assess how signal diversity varied with sleep stage, dreaming and thought-perceptual rating. Signal diversity decreased with sleep depth, but was not significantly different between dreaming and non-dreaming, even though there was a significant positive correlation between Lempel-Ziv complexity of EEG recorded over the posterior cortex and thought-perceptual ratings of dream contents. I explain the difficulty of making various concepts of and relating to probability precise, rigorous and physically significant when attempting to apply them in reasoning about objects living in infinite-dimensional spaces, working through many examples from cosmology. I focus on the relation of topological to measure-theoretic notions of and relating to probability, how they diverge in unpleasant ways in the infinite-dimensional case, and are even difficult to work with on their own. Even in cases where an appropriate family of spacetimes (...) is finite-dimensional, and so admits a measure of the relevant sort, however, it is always the case that the family is not a compact topological space, and so does not admit a physically significant, well behaved probability measure. Problems of a different but still deeply troubling sort plague arguments about likelihood in that context, which I also discuss. I conclude that most standard forms of argument used in cosmology to estimate the likelihood of the occurrence of various properties or behaviors of spacetimes have serious mathematical, physical and conceptual problems. In bilateral logic formulas are signed by + and –, indicating the speech acts assertion and denial. I argue that making an assumption is also speech act. Speech acts cannot be embedded within other speech acts. Hence we cannot make sense of the notion of making an assumption in bilateral logic. Attempts to solve this problem are considered and rejected.

The Radical Enactive/embodied view of Cognition, or REC, claims that all cognition is a matter of skilled performance. Yet REC also makes a distinction between basic and content-involving cognition, arguing that the development of basic to content-involving cognition involves a kink. It might seem that this distinction leads to problematic gaps in REC’s story. We address two such alleged gaps in this paper. First, we identify and reply to the concern that REC leads to an “interface problem”, according to which (...) REC has to account for the interaction of two minds co-present in the same cognitive activity. We emphasise how REC’s view of content-involving cognition in terms of activities that require particular sociocultural practices can resolve these interface concerns. The second potential problematic gap is that REC creates an unjustified difference in kind between animal and human cognition. In response, we clarify and further explicate REC’s notion of content, and argue that this notion allows REC to justifiably mark the distinction between basic and content-involving cognition as a difference in kind. We conclude by pointing out in what sense basic and content-involving cognitive activities are the same, yet different. They are the same because they are all forms of skilled performance, yet different as some forms of skilled performance are genuinely different from other forms. (shrink)

The outcomes of sports and competitive games excite intense emotions in many people, even when those same people acknowledge that those outcomes are of trifling importance. I call this incongruity between the judged importance of the outcome and the intense reactions it provokes the Puzzle of Sport. The puzzle can be usefully compared to another puzzle in aesthetics: the Paradox of Fiction, which asks how it is we become emotionally caught up with events and characters we know to be unreal. In this article, I examine the prospects of understanding our engagement with competitive games on the model of our engagement with works of fiction, thus enabling analogous explanations for both puzzles. I show that there are significant problems with such an approach and offer an alternative, mobilizing ideas from David Velleman and Thomas Nagel, that appeals to the volatility of our motivational attitudes. A well-known theory about under which circumstances a statement is true in a fiction is The Reality Principle, which originate in the work of David Lewis: (RP) Where p1... pn are the primary fictional truths of a fiction F , it is true in F that q iff the following holds: were p1 ... pn the case, q would have been the case (Walton 1990: 44). RP has been subjected to a number of counterexamples, up to a point where, in (...) the words of Stacie Friend “it is widely recognized that the Reality Principle […] cannot be a universal inference rule for implied story-truths” (Friend 2017: 33). This chapter argues that the strength of these counterexamples is widely overestimated, and that they do not, on closer scrutiny, constitute reasons for rejecting RP. (shrink)

The Ethical Question asks whether ethical values in artworks determine their aesthetic value and, if so, how. I argue that the question is ambiguous between a direct and an indirect reading. I show how the indirect reading is philosophically uninteresting because it has an obvious answer: a view called ‘immoralism’. I also show how most of the significant figures in the relevant literature address the indirect form of the question anyway—needlessly, if I am right. Finally, I consider whether some version (...) of the indirect question is more philosophically interesting, connecting it to the so-called ‘qua problem’. I attempt to give clarity to the discussion by applying work on the virtues and vices of explanations. (shrink)

Artificial intelligence is shaping strategy, activities, interactions, and relationships in business and specifically in marketing. The drawback of the substantial opportunities AI systems and applications provide in marketing are ethical controversies. Building on the literature on AI ethics, the authors systematically scrutinize the ethical challenges of deploying AI in marketing from a multi-stakeholder perspective. By revealing interdependencies and tensions between ethical principles, the authors shed light on the applicability of a purely principled, deontological approach to AI ethics in marketing. To (...) reconcile some of these tensions and account for the AI-for-social-good perspective, the authors make suggestions of how AI in marketing can be leveraged to promote societal and environmental well-being. If a work of literary fiction prescribes us to imagine that the Devil made a bet with God and transformed into a poodle, then that claim is true in the fiction and we imagine accordingly. Generally, we cooperate imaginatively with literary fictions, however bizarre, and the things authors write into their stories become true in the fiction. But for some claims, such as moral falsehoods, this seems not to be straightforwardly the case, which raises the question: Why not? The puzzles (...) such cases raise are sometimes grouped under the heading “imaginative resistance”. In this paper, I argue against what I take to be the best attempts to dismiss the puzzles and solve them. I also tease out subtleties not sufficiently addressed in the existing literature and end by defending a unified solution of my own. According to this solution, the puzzling phenomena occur when literary works offer inadequate and exhaustive grounds for claims. The solution’s novelty lies in its giving a normative rather than psychological or alethic explanation for the puzzling phenomena, the relevant norms being those of proper artistic appreciation. The commentaries of professors René Muller and James Phillips exemplify the two most prevalent, contrasting attitudes regarding the role and relevance of ontology for existential psychotherapy. Whereas Muller embraces the need for foundational ontology, Phillips, following the psychiatrist turned philosopher Karl Jaspers, is steadfastly suspicious of it and committed to an ontical approach based on descriptions of the experience of particular individuals. There is much in Muller’s commentary with which I find myself in substantial agreement, including his rejection of Cartesian (...) dualism and commitment to an ontologically unitive understanding of ‘the structure of being human.’ Although Muller recognizes.. According to what I call the Merit Principle, roughly, works of art that attempt to elicit unmerited responses fail on their own terms and are thereby aesthetically flawed. A horror film, for instance, that attempts to elicit fear towards something that is not scary is to that extent aesthetically flawed. The Merit Principle is not only intuitive, it is also endorsed in some form by Aristotle, David Hume, and numerous contemporary figures. In this paper, I show how the principle leads (...) to a novel paradox when applied to an undertheorized class of artworks I call ‘seductive works’. These artworks necessarily invite an unmerited response in order to invite a (merited) repudiation of that response. Thus, according to the Merit Principle, they are necessarily aesthetically flawed, which is counter-intuitive. I consider a number of unsuccessful solutions to the paradox that aim to preserve the Merit Principle, before rejecting that principle as it stands. I discuss what is challenging about seductive artworks, before briefly defending a new principle that appeals to a general way that a work’s aesthetic value is conditioned by the constraints under which it operates. This principle not only resolves the paradox, but explains the competing intuitions that give rise to it. (shrink)

In a discussion of Parfit's Drops of Water case, Zach Barnett has recently proposed a novel argument against “No Small Improvement”; that is, the claim that a single drop of water cannot affect the magnitude of a thirsty person's suffering. We first show that Barnett's argument can be significantly strengthened, and also that the fundamental idea behind it yields a straightforward argument for the transitivity of equal suffering. We then suggest that defenders of No Small Improvement could reject a Pareto (...) principle that is presupposed in Barnett's argument and our developments of it. However, this does not save No Small Improvement, since there is a convincing argument against this claim that does not presuppose the Pareto principle. (shrink)

The article examines how the rules on formation of contract and on mistake, contained in the various transnational model rules that have been published over the past two decades, have taken shape. The approach adopted here is based on an analysis of the ‘textual stratification’ of European private law. The relevant instruments (Convention on Contracts for the International Sale of Goods, Principles of European Contract Law, UNIDROIT Principles of International Commercial Contracts, Draft Common Frame of Reference, Principes contractuels communs) are (...) analysed and compared in their historical sequence. To what extent and why have the texts been transformed in the process? The article demonstrates that there is a very considerable common ground reflecting the state of the art of comparative research in these fields over the past hundred years. It also highlights issues on which consensus must still be reached and it suggests patterns towards reaching such consensus. It is argued that the Principles of European Contract Law, rather than the Draft Common Frame of Reference, should provide the point of departure for future discussions. Recent theoretical analysis has exhibited a structural ambiguity in the normative foundation of the tort of negligence, namely uncertainty whether liability is based on the breach of a legal duty or on the responsibility for the victim's loss. This normative ambiguity is due to the fact that the European law of extracontractual liability was conceptually framed for purposes totally different from modern ideas of fair distribution of risks that have historically been connected with rights- based conceptions of tort law. From (...) a comparative point of view it becomes apparent thatdf the idea of protecting individual rights by tortious remedies is constitutive for the modern European law of extracontractual liability, although hidden beyond the dominant terminology of duties, breach and wrong. Thus it is submitted that a rights-based analysis of the law of torts offers a significantly better understanding than traditional duty-models can achieve. (shrink)

The article analyses and reconstructs a broad idea of legal responsibility which underlies and normatively links tort law with the law of unjustified enrichment. The article’s central proposition is that responsibility for damage caused and enrichment-responsibility are closely interrelated. Both aspects of obligations are equally an expression of corrective justice, and ultimately serve to protect the civil rights of citizens. It is shown that the idea of civil equality and the principle against unjustified enrichment require citizens to assume responsibility not (...) only for the consequences of their misbehaviour, but also for the consequences of lawful actions that non-reciprocally endanger the rights of others. This can be seen particularly clearly in cases of necessity like Vincent v Lake Erie. Under current law, those cases fall in between the categories of unjustified enrichment and wrongs; in most legal systems, they are therefore regarded as particularly hard cases. Nevertheless, the liability of a person lawfully causing damage in a situation of necessity exemplifies the idea of legal responsibility, and thus helps in better understanding the law of non-contractual obligations. Methodologically, the article combines historical arguments derived from the late scholastic theory of restitution with a comparative analysis of Western legal systems and contemporary private law theory. This approach is designed to overcome the conceptual boundaries of national private laws on both sides of the English Channel; it may help to address difficult legal problems more appropriately. The main trust of this article unfolds around the impasse of democratic politics today, marked by the fading belief in the presumably superior architecture of liberal democratic institutions to nurture emancipation on the one hand, and the seemingly inexorable rise of a variety of populist political movements on the other. The first part of the article focuses on the lure of autocratic populism. The second part considers how transforming neoliberal governance arrangements pioneered post-truth autocratic politics/policies in articulation with the imposition (...) of market rule and, in doing so, cleared the way for contemporary illiberal populisms. The third part considers the institutional configuration through which the democratic has been fundamentally transformed over the past few decades in the direction of a post-democratic constellation. The article concludes by arguing for the need to re-script emancipation as a process of political subjectivation unfolding trough a political act. (shrink)

I do not think the notion of rigidity in designation can be correct, at least not in any way that can serve to ground a semantics purports both to be fundamental in a semiotical sense and to the best science of the day. A careful examination of both content and the character of our best scientific knowledge not cannot support anything like what the notion of rigidity requires, but actually shows the notion to be, at bottom, incoherent. In particular, the (...) scientific meaning of natural kind terms can be determined only within the context of a fixed scientific framework and not sub specie aeternitatis. Along the way, I provide grounds for the rejection of essentialist views of the ontology of natural kinds. (shrink)

Jonathan Cohen has claimed that in cases of witness agreement there is an inverse relationship between the prior probability and the posterior probability of what is being agreed: the posterior rises as the prior falls. As is demonstrated in this paper, this contention is not generally valid. In fact, in the most straightforward case exactly the opposite is true: a lower prior also means a lower posterior. This notwithstanding, there is a grain of truth to what Cohen is saying, as (...) there are special circumstances under which a thesis similar to his holds good. What characterises these circumstances is that they allow for the fact of agreement to be surprising. In making this precise, I draw on Paul Horwich's probabilistic analysis of surprise.
